Two things must happen before a new CDL driver touches safety-sensitive work: a verified negative drug test result and a full Clearinghouse query. Not before their first solo run — before their first safety-sensitive function, which includes inspecting, loading, and moving the truck.
The DOT drug test: negative result in hand first
49 CFR §382.301 requires a controlled-substances test before first safety-sensitive use. You must have the verified negative result from the Medical Review Officer (MRO) before the driver starts — not just a completed collection. MRO verification takes days, so test early in onboarding, not the morning of first dispatch.
The required pre-employment test is for drugs only. Alcohol pre-employment testing is optional.
The narrow exception (that rarely helps)
You can skip the pre-employment test only if all three of these are true. The driver participated in a compliant DOT testing program within the previous 30 days. They were tested in the past 6 months, or were in a random pool for the previous 12 months. And no prior employer has a violation on record for them in the past 6 months (§382.301(b)). You must verify all of that with the prior program before relying on it. Most small carriers just run the test — it’s cheaper than the verification legwork.
The Clearinghouse query is separate
The pre-employment full Clearinghouse query is its own requirement with its own consent flow. A clean drug test doesn’t satisfy it, and a clean query doesn’t satisfy the test. You need both, documented, before dispatch.

Getting your own authority? You’re the employer hiring yourself as a driver, and both requirements apply to you — a pre-employment test and a query on your own record before your first load. New-entrant audits look hard at this file — it’s one that new owner-operators often skip.
